Terms of Use

These terms govern your use of the RepHQ app. They are not the commercial contract: RepHQ is licensed to your employer under a separate agreement, and nothing here changes what your employer has agreed with us.

The short version: RepHQ is a sales tool, not a clinical one. Your employer gives you the account and pays for it. Never enter patient information. Registry figures are commercial intelligence, never a judgement about a clinician's performance, and the reference dataset is ours — use it in the app, do not extract it.

1. Who we are, and what these terms are

RepHQ is provided by REPHQ LTD, incorporated in England and Wales, company number 17256173, registered office 91 Bates Avenue, Darlington, DL3 0TS.

These terms govern your personal use of the app. They are not the commercial contract. RepHQ is licensed to your employer under a separate agreement — an order form, master terms and a data processing agreement — and nothing here changes what your employer has agreed with us.

By signing in, you agree to these terms. If you do not agree, do not use the app.

2. What the app is

RepHQ is a territory-scoped customer relationship tool for orthopaedic medical device sales representatives. It provides contact and account management for healthcare professionals and hospitals, visit logging, follow-ups, territory and market information, and registry-derived reference data.

RepHQ is not a clinical tool. It must not be used for any clinical, diagnostic, treatment or patient care purpose, and nothing in it is medical advice or a measure of clinical quality.

3. Who may use it

You may use RepHQ only if you are 18 or over, are using it for legitimate professional activity in the medical device sector, and have been given an account by an organisation licensed by us.

RepHQ is not offered to consumers and is not available for personal use or individual purchase.

4. Your account

Accounts are created by your employer's administrators. You cannot create one yourself.

You must keep your credentials confidential and must not share them or let anyone else use your account. Everything done under your account is treated as done by you. Tell us at requests@rephq.co.uk immediately if you think someone else has access.

Your employer controls your account and can suspend or remove it at any time. When they deactivate you, your access ends immediately, and the records you created stay in their account, still attributed to you, so their visit history and audit trail remain intact.

5. Data protection

We process personal data as described in our Privacy Policy. We are registered with the ICO under reference ZC231873.

For the content you enter, your employer is the data controller and we act as their processor. Questions about that content go to your employer first.

You must ensure that anything you record about another person is accurate, lawfully obtained, and something you are entitled to hold. You must follow your employer's own data protection policies.

5.1 What you must never enter

  • Patient-identifiable information of any kind
  • Clinical records, or any information about an individual's health
  • Special category data under Article 9, or criminal offence data
  • Anything obtained in breach of a confidentiality obligation
  • Anything you do not have the right to hold

We may remove such information without notice and will tell your employer we have done so.

6. Registry and reference data

RepHQ shows information derived from published sources including the National Joint Registry, the GMC register, NHS Digital, NHS PROMs and ODEP.

This data:

  • is provided for commercial sales intelligence only
  • may be incomplete, superseded or subject to registry revision
  • is not a measure of any clinician's or hospital's clinical quality, and must never be presented as one
  • is supplied without warranty of accuracy or fitness for any purpose

You must not remove, obscure or alter source attributions. Screens and exports carrying NJR-derived figures display the NJR source line and, in full-length views, the registry's standardised acknowledgement. Those must remain intact wherever the information is reproduced.

Presenting registry figures to a clinician as a judgement about their performance is a misuse of this data and a breach of these terms.

7. Acceptable use

You must not:

  • Use RepHQ for anything other than legitimate professional medical device sales activity
  • Enter false, misleading or defamatory information
  • Use it to harass, stalk or inappropriately contact anyone
  • Attempt to access another user's account, or data outside your territory or segment
  • Reverse engineer, decompile or extract source code
  • Use bots, scrapers or automated tools against the app
  • Resell, sublicense or commercially exploit RepHQ or its content
  • Upload malicious code
  • Breach any applicable law or regulation

7.1 Industry conduct

Medical device sales in the UK is governed by industry codes and anti-bribery law. You must comply with your employer's compliance policies, applicable industry codes of practice, and the Bribery Act 2010.

You must not use RepHQ to record, plan or facilitate any improper inducement or payment intended to influence clinical or procurement decisions. Where your employer is subject to transparency or disclosure obligations for engagements with healthcare professionals, records you keep here do not discharge those obligations.

7.2 Extraction of reference data

The registry-derived reference dataset is RepHQ's own intellectual property and a substantial part of the value of the product.

You must not bulk extract, copy, scrape, republish or resell it, use it to build or improve a competing product or dataset, or make it available to anyone outside the licensed organisation. Ordinary use of the app — viewing records, exporting a single visit — is permitted.

8. Fees

You pay nothing. RepHQ is licensed to your employer, who pays under a separate agreement. Fees, seat counts, renewal and termination are matters between us and them.

9. Intellectual property

RepHQ, its software, design and reference dataset are owned by or licensed to REPHQ LTD. Nothing here transfers any of it to you.

Content entered through the app belongs to and is controlled by your employer under their agreement with us, not by you personally. You grant us the licence we need to store and process it in order to provide the service.

10. Disclaimers and liability

No clinical use. We exclude all liability for any clinical use of RepHQ, or any clinical decision made in reliance on it.

Accuracy. We do not warrant that any information displayed is accurate, complete or current, particularly registry data, which we present as published and which changes over time.

Availability. We do not guarantee uninterrupted or error-free access.

Our commercial liability is set out in the agreement with your employer. As between you and us, we exclude liability to the fullest extent the law allows.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be excluded.

11. Suspension and termination

We may suspend or end your access if you materially breach these terms and do not put it right within 14 days, if we reasonably believe your account is being misused, if your employer's licence ends, or if we discontinue the app.

Your employer's rights to export and deletion on termination are in the data processing agreement. You have no separate right to export their content.

12. Changes

We will give at least 14 days' notice of material changes, in the app or by email, and will tell your employer directly. Continuing to use RepHQ after that means you accept them.
